2. Definition of terms

The terms used by RIGK in this Privacy Policy include the following:

a) personal data

Personal data is all information that relates to an identified or identifiable natural person (hereinafter: your etc.): A natural person is considered identifiable if they can be identified directly or indirectly, in particular using allocation to an identifier such as a name, ID number, location data, an online user name or one or more particular features that express the phyiscal, physiological, genetic, psychic, economic, cultural or social identity of this natural person.

b) data subject

A data subject is any identified or identifiable natural person whose personal data is processed by the data controller for the processing.

c) processing

Processing is any process executed with or without the help of automated methods or a series of such processes in connection with personal data, such as collection, recording, organisation, ordering, saving, adaptation or amendment, reading, querying, use, disclosure through transmission, distribution or any other form of provision, matching or linking, limitation, erasure or destruction.

d) data controller or person responsible for processing

The data controller or person responsible for processing is the natural person or legal entity, authority, institution or other body that decides alone or together with others on the purposes and means of processing personal data. Where the purposes and means of this processing are prescribed by the law of the European Union or the member states, the person responsible or the specific criteria for his appointment may be provided in accordance with the law of the European Union or the member states.

e) processor

A processor is a natural person or legal entity, authority, institution or other body that processes personal data on behalf of the person responsible.

f) recipient

A recipient is a natural person or legal entity, authority, institution or other body to which personal data is disclosed, regardless of whether or not this is a third party. However, authorities that may receive personal data as part of a specific investigation assignment in accordance with the law of the European Union or the member states are not considered recipients.

g) third party

A third party is a natural person or legal entity, authority, institution or other body apart from you, the person responsible, the processor or the persons who are authorised to process the personal data under the direct responsibility of the person responsible or the processor.

h) permission

Permission is any expression of consent submitted by you voluntarily, for the specific case, in an informed way and unmistakeably in the form of a declaration or other unambiguous, confirming action with which you make it understood that you agree to the processing of the personal data affecting you.

3. Collection and storage of personal data and type and purpose of use

a) when visiting the website

When you access our website https://www.international-recycling-forum.de/, information is automatically sent to the server of our website by the browser used on your end device. This information is saved temporarily in a log file. The following information is collected and saved until the next automatic erasure:

  • IP address of the computer used to access the website
  • Date and time of access
  • Name and URL of the file accessed
  • Website from which the site is accessed (referrer URL)
  • Browser used, operating system of your computer if applicable, name of your access provider

RIGK uses the aforementioned data for the following purposes:

  • To guarantee a smooth connection to the website
  • To guarantee convenient use of the RIGK website
  • To analyse system security and stability
  • For other administrative purposes

The legal basis for data processing is Art. 6 Para. 1 Clause 1 lit. f GDPR. The vital interest of RIGK results from the purposes of data collection listed above. RIGK never uses the data collected for the purpose of drawing conclusions on your person. RIGK also use cookies and analysis services when you visit our website. You can find more details on this in Sections 8 and 9 of this Privacy Policy.

b) when registering for the international Recycling Forum

In order to registering for the international Recycling Forum, you need to provide RIGK with the following information about yourself:

  • Contact details
    • First name
    • Last name
    • Company and position
    • Address
    • Telephone number
    • Email address

Should you register for an event,

  • participation of a guest and
  • any dietary requirements (vegetarian/vegan)

will also be recorded.

RIGK uses the aforementioned data for the following purposes:

  • To provide specific information
  • To guarantee that the event runs smoothly
  • For communication purposes

Data processing for the purposes of registering for the international Recycling Forum with RIGK is in accordance with Art. 6 Para. 1 p. 1 lit. a GDPR, based on your voluntarily given consent.

RIGK transmits the data required in order to process and send the registration confirmation for the international Recycling Forum to external service providers with whom a processing contract based on Art. 28 GDPR is in place.

The personal data collected by RIGK for the use of the contact form will be archived and saved until the purpose is met and the statutory erasure periods fulfilled.

4. Data disclosure

Your personal data will not be transmitted to third parties for any purpose other than the purposes listed below.

RIGK only discloses your personal data to third parties in the following cases:

  • You have given your explicit consent in accordance with Art. 6 Para. 1 Clause 1 lit. a GDPR,
  • Disclosure is required in accordance with Art. 6 Para. 1 Clause 1 lit. f GDPR for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest in the non-disclosure of your data that is worthy of protection.
  • There is a legal obligation to disclose in accordance with Art. 6 Para. 1 Clause 1 lit. c GDPR.
  • It is lawfully permissible and required for the processing of contractual relationships with you in accordance with Art. 6 Para. 1 Clause 1 lit. b GDPR.

5. Scope of processing of personal data

RIGK only processes personal data on their users where this is required in order to provide a functional website as well as content and services by RIGK. Personal data is usually only processed with the permission of the user. An exception applies in cases in which it is not possible to gain permission for practical reasons and the processing of the data is permitted by statutory provisions.

6. Legal basis for the processing of personal data

Where RIGK obtains permission from you for the processing of personal data, Art. 6 Para. 1 lit. a GDPR shall serve as the legal basis.

Art. 6 Abs. 1 lit. b GDPR shall serve as the legal basis for the processing of personal data that is required in order to fulfil or process a contract or pre-contractual measures.

Where processing of personal data is required in order to fulfil a statutory obligation to which RIGK is subject, Art. 6 Para. 1 lit. c GDPR shall serve as the legal basis.

Where processing is required in order to safeguard a vital interest of RIGK or a third party and your interests, basic rights and basic freedoms do not outweigh the aforementioned interest, Art. 6 Para. 1 lit. f GDPR shall serve as the legal basis for the processing.

7. Data erasure and storage period

Your personal data will be erased or blocked as soon as the purpose of storage expires. Data may also be saved where this is prescribed by European or national legislation in the form of EU directives, laws or other provisions to which the responsible person is subject. Data may also be blocked or erased when a storage period prescribed by the aforementioned standards expires, unless further storage of the data is required for conclusion or fulfilment of a contract.

8. Cookies

RIGK uses cookies on its website. These are small files that are created automatically by your browser and saved on your end device (laptop, tablet, smartphone etc.) when you visit their website. Cookies do not damage your end device, nor do they contain viruses, trojans or other malware.

The cookie stores information gathered in relation to the specific device used. However, this does not mean that RIGK is directly aware of your identity.

The data processed by cookies is required for the purposes stated in order to protect the vital interests of RIGK and of third parties in accordance with Art. 6 Para. 1 Clause 1 lit. f GDPR.

9. Google Analytics

In order to continuously optimise the website and structure it in line with demand, RIGK uses Google Analytics, a web analysis service from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). This involves the creation of pseudonymised usage profiles and the use of cookies (see Section 8). The information on your use of this website generated by the cookie, such as:

  • browser type/version,
  • operating system used,
  • referrer URL (the site visited before),
  • host name of the accessing computer (IP address),
  • time of server request,

is usually transmitted to a Google server within the EU or European Economic Area and saved there. However, saving in the USA cannot be ruled out. The information is used to analyse use of the website, compile reports on website activity and provide further services in connection with the use of the website and the internet for the purposes of market research and demand-based structure of this website. The information may also be transmitted to third parties where this is required by law or such third parties process it on our behalf. Your IP address will never be linked to other data by Google. The IP addresses are anonymised so that they cannot be attributed (IP masking).

10. Social media links and plug-ins

Based on Art. 6 Para. 1 Clause 1 lit. f GDPR, RIGK uses links to the social networks YouTube and Linkedin on its website in order to raise the profile of the company. The advertising purpose of this is considered a vital interest under the GDPR. The provider in each case is responsible for guaranteeing operation that complies with data protection.

a) LinkedIn

The website provides a link to the LinkedIn network provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Accessing the link to LinkedIn creates a connection to LinkedIn servers. LinkedIn receives notification that you have visited the RIGK website with your IP address. If you click the LinkedIn link while you are logged in to your LinkedIn account, LinkedIn can attribute your visit to the RIGK website to you and your user account.

b) YouTube

Our website includes a link to YouTube to enable you to view company-specific posts and videos. You can recognise the link by the YouTube logo on the website. If you click on the link, your browser will be connected directly with the YouTube servers. As a result, YouTube receives the information that you visited the RIGK website with your IP address. If you are logged in to your YouTube account at the same time, you enable YouTube to attribute the visit to the website to your account. You can prevent this by logging out from your account first. 11. Rights of the data subject

Your rights:

  • In accordance with Art. 15 GDPR, you have the right to demand information about the personal data on you that RIGK processes. In particular, you can demand information on the purposes of processing; the category of personal data; the categories of recipients to whom your data is or was disclosed; the planned storage period; the existence of a right to rectification, erasure, restriction of processing or objection; the existence of a right of complaint; the source of your data if not collected by us; and the existence of automated decision-making including profiling and meaningful information about the details of this.
  • In accordance with Art. 16 GDPR, you have the right to demand the immediate rectification or completion of your personal data stored by RIGK.
  • In accordance with Art. 17 GDPR, you have the right to demand the erasure of your personal data stored by RIGK, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims.
  • In accordance with Art. 18 GDPR, you have the right to obtain restriction of processing of your personal data where you contest the accuracy of the data, the processing is unlawful but you oppose its erasure, or RIGK no longer needs the data but you require it for the establishment, exercise or defence of legal claims, or you have objected to the processing in accordance with Art. 21 GDPR.
  • In accordance with Art. 20 GDPR, you have the right to obtain your personal data you provided to RIGK in a structured, commonly used and machine-readable format and to demand transmission of that data to another controller.
  • In accordance with Art. 7 Para. 3 GDPR, you have the right to withdraw you consent from RIGK at any time. This will mean that RIGK is not permitted to continue the data processing based on this consent in future.
  • In accordance with Art. 77 GDPR, you have the right to lodge a complaint with a supervisory body. You can usually do this by contacting the supervisory body in your habitual place of residence, place of work, or the company seat of RIGK.

12. Right of objection

Where your personal data is processed based on vital interests in accordance with Art. 6 Para. 1 Clause 1 lit. f GDPR, you have the right, in accordance with Art. 21 GDPR, to object to the processing of your personal data on grounds relating to your particular situation or where the objection is to direct marketing. In the latter case, you have a general right to objection, which RIGK shall implement without specification of a particular situation.

Data security

During your visit to our website, RIGK uses the common SSL (secure socket layer) process combined with the highest level of encryption your browser supports. This is usually 256--bit encryption. If your browser does not support 256-bit encryption, RIGK uses 128-bit v3 technology instead. You can see whether a particular page of the RIGK website is transmitted in encrypted form by the closed key or padlock icon in the status bar at the top of your browser.

RIGK also uses appropriate technical and organisational security measures to protect your data against accidental or deliberate manipulation, partial or total loss, destruction or unauthorised access by third parties. RIGK’s security measures are continuously improved in line with technological progress.
